The use of distinctive signs for collective use in the development, protection, and promotion of creative territories.Intellectual property. Creative economy. Sustainable development.
The creative economy plays an essential role in economic and social growth, strengthening culture and driving innovation across different fields. In this context, creative territories emerge as environments that encourage cultural expressions, foster diversity, and create economic opportunities based on creativity and local heritage. Aiming at the sustainability and development of these creative economy ecosystems, this study’s main objective was to investigate how collective distinctive signs can be used as tools for the development, promotion, and protection of creative territories. To achieve these objectives, a qualitative method with an exploratory and descriptive approach was adopted. Initially, a Systematic Literature Review was conducted to provide a theoretical foundation on the creative economy, creative territories, and distinctive signs. Subsequently, the identification of collective marks, certification marks, and geographical indications was carried out through documentary research in the database of the Brazilian National Institute of Industrial Property (INPI). The investigation into the use of distinctive signs in territories was conducted through semi-structured interviews with different actors in the creative economy. Finally, the Business Model Canvas methodology was applied to structure a technical framework and planning focused on Porto Alegre. The results revealed a mismatch between the theoretical potential of distinctive signs and their still incipient practical application in Brazil, driven by barriers such as lack of technical knowledge, the perception of high bureaucratic complexity, and sociocultural challenges related to individualism. As practical suggestions to overcome these challenges and fulfill the main objective of the research, the study proposed the implementation of a certification mark managed by the municipal public authority, as well as the promotion of collective marks through existing anchor institutions within the territories. The study thus aims to support the formulation of public policies and provide guidelines to promote sustainable development and the appreciation of cultural identity at the municipal level.
